These terms govern your use of this website and any account application submitted through it. Please read them before using the site. If you do not accept them, do not use the site.
01Acceptance of these terms
By accessing this website you agree to be bound by these terms and by our Privacy Policy. If you open an account with us, your relationship will additionally be governed by the account agreement, general banking conditions and any product-specific terms we provide to you. Where those documents conflict with these terms, those documents prevail in respect of your account.
02Regulatory status
Lumier Private Bank is licensed as an offshore bank in Anjouan, Union of the Comoros, under licence number 16305, and is supervised by the licensing authority of that jurisdiction.
Our licence authorises us to carry on banking business from within Anjouan. It is not a banking authorisation in your country of residence, and it does not give us permission to carry on regulated activities in other jurisdictions. Deposits held with us are not covered by any deposit guarantee, deposit insurance or investor compensation scheme, including those operated in the European Union, the United Kingdom, the United States, Switzerland or Singapore. If we were to become unable to meet our obligations, no public compensation scheme would reimburse you, and you could lose the full amount of your deposit. You should take independent advice and satisfy yourself that this arrangement is appropriate for you before placing any funds with us.
03No offer or solicitation
The content of this website is provided for general information only. It is not an offer to sell, a solicitation of an offer to buy, or a recommendation in respect of any banking service, deposit, security or investment, and it is not directed at any person in any jurisdiction where its publication or availability would be contrary to local law or regulation.
Nothing on this website creates a banking relationship, a contractual obligation, or a duty of care between us and you.
04Eligibility and territorial restrictions
Our services are available only where we may lawfully provide them. Access to this website from a particular country does not imply that we are permitted to offer services there.
You may not apply for or hold an account with us if doing so would breach any law applicable to you, or if you are:
- subject to sanctions imposed by the United Nations, the European Union, the United Kingdom, the United States or the Union of the Comoros, or resident in a jurisdiction subject to comprehensive sanctions;
- resident in a jurisdiction where we have determined we cannot lawfully offer services;
- under eighteen years of age; or
- acting for an undisclosed third party.
It is your responsibility to establish whether you may lawfully use our services, and to comply with the tax, reporting and exchange-control obligations that apply to you in your country of residence. We do not provide tax advice and we do not assume responsibility for your tax position.
05Account applications
Submitting an application through this website is an enquiry only. It does not create an account, does not oblige us to open one, and does not entitle you to transfer funds to us.
Before any relationship is opened we will carry out customer due diligence, verify your identity, and require evidence of your source of wealth and source of funds. We may decline an application at our discretion and are not obliged to give reasons. Any minimum relationship size we indicate is a guide and does not bind us.
You confirm that the information you give us is accurate and complete, and you agree to inform us promptly if it changes. Providing false or misleading information to a bank is a criminal offence in most jurisdictions and will result in your application being refused or your relationship being terminated.
06Client portal and security
Access to the client portal is restricted to clients holding valid credentials. You are responsible for keeping your credentials and authentication devices secure and confidential, and for all activity carried out under your login.
You agree to notify us immediately if you suspect unauthorised access. We will never ask you for your password or one-time authentication codes by email or telephone, and you should treat any such request as fraudulent. We may suspend access without notice where we consider it necessary to protect you, us or the integrity of our systems.
You must not attempt to gain unauthorised access to any part of the site or its systems, introduce malicious code, scrape or harvest data, or use the site in any way that interferes with its operation.
07No advice
Information on this website is not investment, legal, tax or accounting advice, and does not take account of your objectives, financial situation or needs. Any reference to services such as portfolio management or advisory mandates describes what may be available under a separate written agreement; it is not advice in itself.

The site may link to third-party websites. We do not control them, do not endorse their content, and accept no responsibility for them. Following such a link is at your own risk and the third party's own terms and privacy practices will apply.
11Availability of the website
We aim to keep the site and the client portal available, but access is provided on an "as available" basis. We may suspend, withdraw or restrict all or part of the site for maintenance, security or operational reasons, and we do not guarantee uninterrupted or error-free access.
12Limitation of liability
To the fullest extent permitted by law, we exclude liability for loss or damage arising from your use of, or inability to use, this website, including indirect or consequential loss, loss of profit, loss of business, or loss arising from reliance on information published here.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded. This clause does not affect your rights under the account agreement, which sets out our liability in respect of the services we provide to you as a client.
13Complaints
If you are dissatisfied with our service, write to us at the address in section 16, marking your correspondence for the attention of the Complaints Officer. We will acknowledge your complaint within five business days and aim to provide a final response within eight weeks.
Because we are licensed in Anjouan, complaints that cannot be resolved with us are escalated to the licensing authority of that jurisdiction. You should be aware that you will not have recourse to an ombudsman or financial services compensation scheme in your own country in respect of your relationship with us.
14Governing law
These terms and any dispute arising out of them are governed by the laws of Anjouan, Union of the Comoros, and are subject to the exclusive jurisdiction of its courts. Where mandatory consumer protection law in your country of residence gives you additional rights, those rights are not affected.
15Changes to these terms
We may revise these terms from time to time. The version published on this page is the version in force, and the date at the top shows when it was last revised. Your continued use of the site after a revision constitutes acceptance of it.
